Teen alleges his drunk driving accident is officer's fault PoliceOne Staff Report
(BRADENTON, Fla.) -- A teenager whose blood tested at twice the legal alcohol level permitted for adults after rupturing his aorta when he drove drunk into a tree is suing police for allegedly allowing him to drive away from a disturbance.

Richard L. Garcia, who was 16 when the accident occurred on Feb. 9, 1999 claims that a former patrol officer observed him obviously drunk but allowed him to drive away in a vehicle with open beer cans.

The officer did not mention the youth's intoxication in his report, according to the attorney who filed the suit last week for Garcia. Later the officer resigned after admitting a crack cocaine habit, according to the Associated Press.
