(BOSTON) -- One of two men convicted for the 1995 slaying of Boston police Detective John Mulligan was held without bail yesterday in Suffolk Superior Court as the process began for the fifth trial in that murder case.

Terry Patterson, 27, was granted a new trial last month by the Supreme Judicial Court after the court said Patterson's original trial attorney, Nancy Hurley, should have withdrawn from the case and become a witness for Patterson.

The second defendant in the Mulligan murder, Sean Ellis, was tried three times, with the first two trials ending in hung juries and the third ending in a conviction.
