Officer Down: Deputy Constable John David Garcia - [Magnolia, Texas]
A Montgomery County deputy constable died instantly Thursday afternoon when the top of his patrol car was smashed by an airborne sport utility vehicle on Texas 149.
The victim was identified as John David Garcia, 33, of Magnolia. He had worked for Precinct 5 Constable David Hill for the the past four years and previously was employed by the Precinct 1 constable in Conroe, said Matt Masden, Precinct 5 chief deputy.
"He was a fine man who will be greatly missed," Masden said.
Garcia, who had been on patrol duty when the accident occurred, leaves behind a wife and 13-year-old daughter, Masden said.
The three-vehicle accident occurred about 2:00 p.m. on Texas 149 near where it intersects FM 1488 outside Montgomery, Texas Department of Public Safety Trooper Steve Hargett said.
According to witnesses, the patrol car was following a pickup pulling a trailer south on Texas 149 when the driver of an SUV heading north veered across the yellow line.
The SUV clipped the back panel of the truck, then climbed over the trailer and flew atop the patrol car, Hargett said.
"The whole top of the squad car was gone," Hargett said.
None of the occupants of the two other vehicles was injured.
The investigation is continuing and charges could be filed at a later date, the trooper said.
