PHOENIX — Unsealed federal court records identify a second man in the December 2010 killing of Arizona Border Patrol Agent Brian Terry near Naco.

The U.S. District Court documents identify him as 41-year-old Rito Osorio-Arellanes, who is believed to be the brother of the only previously named defendant, Manuel Osorio-Arellanes. A third man has not been identified in public records because he hasn't been caught.

The Arizona Republic reports both men are under indictment in the killing of Terry, who died during a shootout with men who attacked suspected illegal immigrants and drug smugglers.

Terry's killing drew additional attention when two guns found at the scene were connected to a botched federal operation known as Fast and Furious in which illegally obtained weapons were allowed across the border into Mexico.
