BROCKTON, Mass. — The man who was shot by a state trooper in Brockton on Saturday morning, later identified as a 25-year-old from Fall River, is now facing five criminal charges including assault with intent to murder after police said he pointed a gun at the trooper.
Claude W. Brown-Madison, 25, who is a Fall River resident but previously lived in Brockton, was the man shot by a state trooper in self-defense just before 9 a.m. on Colonel Bell Drive near Sullivan Towers, according to Massachusetts State Police. Brown-Madison is being charged with armed assault with intent to murder, assault by means of a dangerous weapon, committing a firearm violation while having a record that includes at least three prior violent or drug crimes, unlawful possession of a firearm, and possession of a firearm without an FID card.
“Investigation thus far indicates that Brown-Madison was armed during the incident and pointed a firearm at the trooper,” said Dave Procopio, a spokesperson for Massachusetts State Police, in a statement released to the media. “The suspect’s firearm was recovered at the scene of the shooting.”
State police announced the charges in a press release on Saturday night, declining to go into further detail about the incident.
“The facts and circumstances that led to the trooper’s confrontation with the suspect remain part of the ongoing investigation,” Procopio said.
Brown-Madison will be arraigned when doctors determine he is medically fit do go through the arraignment hearing, according to state police. Brown-Madison sustained a lower body gunshot wound, and remained hospitalized under state police guard at Boston Medical Center.
On Sunday, Massachusetts State Police and prosecutors declined to release the name of the trooper who pulled the trigger to shoot Brown-Madison. The Cape and Islands District Attorney’s Office are overseeing the investigation of the shooting, and will determine whether the use of potentially lethal force was justified under the law, according to Procopio. The Essex County District Attorney’s Office will prosecute Brown-Madison for the five charges filed against him, Procopio said. Removing the case from the Plymouth County DA’s Office was done to eliminate a potential appearance of a conflict of interest, he said.
“The matter is still under investigation,” said Cara Winslow, of the Cape and Islands District Attorney’s Office, in an email to The Enterprise on Sunday.
According to an online archive of the Brockton police log, Brown-Madison was charged in connection to a July 2011 home invasion on Auburn Street, where weapons were shown, residents of the home were tied up, and the victims were robbed. In that case, Brown-Madison, 18 at the time and living in Brockton, was charged with home invasion and three counts of assault and battery with a dangerous weapon, according to the online archive.
